Representation Summary:

Policy DM29 appears to make provision for new development to meet existing open space deficiencies. This would be contrary to Regulation 122 of the CIL Regulations. Paragraph two implies that the extent of provision within an area will inform the contributions sought from new development. This could to be used to justify additional provision to meet existing deficiencies in the area. This does not accord with the law on this matter. Evidence to support the provisions of Appendix 6 should be published. Without it, the degree to which the Policy is evidence based and the most appropriate alternative is questioned.
